Worcester County Circuit Court Clerk

The Clerk of the Circuit Court at One W. Market Street in Snow Hill maintains all deed records for Worcester County. The office hours are Monday through Friday, 8:00 AM to 4:30 PM. Note that this office opens at 8:00 AM, which is slightly earlier than most Maryland circuit court clerks. Electronic recording (e-recording) is now available for deed transfers in Worcester County. Contact the Treasurer's Office at (410) 632-0686 option 3 for information on the e-recording process.

Public access terminals at the courthouse let you search Worcester County deed records during office hours. You can search by grantor or grantee name, book and page reference, or instrument type. Staff can help with records that are not yet fully indexed online. When you find the deed you need, request a copy at the counter. The clerk will also process certified copy requests for a higher fee.

Worcester County Deed Validation and 2025 Tax Change

Worcester County has a deed validation process that is not found in most other Maryland counties. Every deed must be stamped by the Worcester County Treasurer's Office before the circuit court clerk will accept it for recording. The Treasurer's stamp verifies that all property taxes are paid, that water and wastewater charges are current, and that any personal property taxes owed on the transaction are collected. A major change took effect on January 1, 2025. The recordation tax in Worcester County is now collected by the Treasurer's Office rather than the Clerk of Circuit Court. If you are recording a deed in Worcester County, you must bring a separate check for the recordation tax made payable to Worcester County. Do not include the recordation tax in your payment to the circuit court clerk. This is a separate transaction at a separate office. Call the Treasurer at (410) 632-0686 option 3 with any questions about this change.

Properties in the incorporated towns of Berlin, Ocean City, Pocomoke City, and Snow Hill have an additional step. Deeds for these properties must be presented to the town before recording. Worcester County collects real estate taxes on behalf of these towns, but each town still requires its own stamp on the deed. Check with the town clerk's office before you bring the deed to the circuit court. Missing a town stamp will prevent recording.

Worcester County Recording Fees and Taxes

Recording fees in Worcester County follow the statewide schedule with a surcharge. A deed with nine pages or fewer costs $20 to record. A deed with ten or more pages costs $75. Releases cost $10. A $40 surcharge applies to all land record filings in Worcester County. Copy fees are $0.50 per page for plain copies. Certified copies add $5.00 to the total.

Taxes are separate from recording fees and are paid at the Treasurer's Office as part of the deed validation step. As of January 1, 2025, the recordation tax rate is $6.60 per $500 of consideration. The state transfer tax is 0.5% of the consideration. The county transfer tax is also 0.5%. For owner-occupied principal residences, the first $50,000 of consideration is exempt from the county transfer tax. These rates apply under Maryland Code, Real Property Article § 3-201 and related provisions. Always confirm current rates with the Treasurer before you record.
